AGREED ORDER ON PARTITION SALE

1: THE REAL ESTATE SHALL BE SOLD AT PUBLIC AUCTION BY THE SHERIFF OF VAN WERT COUNTY THROUGH THE EFFORTS OF THE AUCTION AND REAL ESTATE FIRMS OF STRALEY REALTY & AUCTIONEERS, INC. AND BEE GEE REALTY & AUCTION CO.

2: SALE SHALL OCCUR ON 14 AUGUST 2008 AT 10:00 AM AND BE HELD AT VANTAGE VOCATION SCHOOL, VAN WERT, OHIO.

3: THE ENTIRE SALE AND/OR INDIVIDUAL PARCEL SALES ARE SUBJECT TO A MINIMUM OF TWO-THIRDS (2/3) OF THE APPRAISED PUBLISHED PRICE.

4: EACH PARCEL (11) TO BE SOLD INDIVIDUALLY AND THEN IN ANY COMBINATION AS GAINED BY SUCCESSFUL BID.

5: TERMS SHALL REQUIRE OF DEPOSIT OF TEN (10) PER CENT OF THE SUCCESSFUL BID WITH SUCH FUNDS PAYABLE TO THE VAN WERT COUNTY SHERIFF.

6: BALANCE DUE AT CLOSING, NOT LATER THAN THIRTY (30) DAYS FROM THE DATE OF SALE; FARM POSSESSION GIVEN UPON THE LATTER OF: HARVEST OF 2008 CROPS OR CLOSING DATE; HOME POSSESSION UPON CLOSING; ALL CURRENT CROPS PROPERTY OF THE SELLERS.
