Sale of 80 acres of farmland west of Payne, OH, located in Section 34, Harrison Township, Paulding County.

Tract #1:  28 Acres, well-tiled, primarily Hoytville soil; road frontage on St. Rt. 613

Tract #2:  52 Acres, well-tiled, primarily Hoytville soil; 20' easement along railroad; frontage on Road T-33

Farmland will be sold by multi-parcel sales method: first offered separately as 2 parcels and then as entire package or separately, selling for whichever brings most money.

CONDITIONS:  1. Public Auction; 2. Multi-parcel sale (We will auction each parcel and post the bid. Buyers will then have the right to mix and match parcels any way they wish); 3. Any new bid on a combination or individual parcel must raise the total bid by $1,000.00; 4. Potential Buyers must register and obtain a bid number to bid; 5. No bids will be subject to financing; 6. Buyer of multiple parcels will receive one deed; and 7. Selling subject to confirmation of Seller.

TERMS:  1. $10,000 down day of sale on Tract #1 and $25,000 down day of sale on Tract #2; 2. Closing will be on or before Oct. 11, 2008; 3. Farm selling subject to tenant farmer's rights with possession upon harvest of fall crops; 4. Seller to pay 2008 expenses and receive 2008 Landlord share of crops & government payments earned in 2008; 5. Seller to pay all 2008 taxes with Buyer responsible for 2009 taxes and beyond. 6. Seller to provide survey. 7. Seller to furnish warranty deed and pay prevailing transfer tax; 8. Buyer responsible for any recoupment of taxes if land not used for agriculture; 9. Any deviations from these terms will be announced verbally prior to the start of the auction.
